Faces of FearlessSM Award Official Rules

The Faces of FearlessSM award program (the "Award Program") is open only to legal residents of the fifty (50) United States (and the District of Columbia), Panama, Uruguay, or Puerto Rico who are at least twenty-one (21) at the time of entry and are insured by a licensed BCBS company (each, together with its BCBS-licensed affiliates, only, a “BCBS Company”) continuously during the entire time period from 01/24/17 up to and including 05/31/17 (the "Eligibility Period"), who submit a Faces of Fearless story and photos that meet the Submission Guidelines described below and pertain to true events that happened to that individual on or after 01/01/2012 and also occurred at a time when that individual was insured by a BCBS Company. NO OTHER PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited. The Award Program is governed by these Official Rules and is subject to all applicable federal, state and local laws. Proof of residency and age may be required. Employees and directors of Blue Cross and Blue Shield Association and each BCBS Company, and their respective advertising, promotional or travel agencies or individuals involved with the design, production, execution or distribution of the Award Program and the immediate family and household members of such individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not.  

Entry Period

Award Program entry period begins on January 24, 2017 and ends March 30, 2017 at 5pm CST (the "Entry Period"). The computer clock of the Sponsor is the official timekeeping device.

How to Enter

To enter the Award Program you must visit BCBS.com/about-us/live-fearless/faces-fearless (the "Program Microsite") during the Entry Period and provide all required registration information and consents. Once registered, you must follow the prompts to "share your fearless moment," and submit a detailed story and photos or video (collectively, an "Entry") which comply with the Submission Guidelines detailed below. There is a limit of one (1) entry per person. All Entries must be in compliance with these Official Rules, including, without limitation, the Submission Guidelines. Proof of submission of entry does not constitute proof of delivery or receipt by Sponsor or entry during the Entry Period. All Entries become the property of Sponsor and will not be acknowledged or returned, and no correspondence will be entered into by Sponsor to entrant regarding the status of an Entry. Multiple entrants are not permitted to share the same email address or account and entrant may not participate with multiple e-mail addresses.   Entrant may not use any device or artifice to enter multiple times or as multiple entrant. Entries received from any person, regardless of email address used, in excess of the above stated limitation, will be void. Incomplete entries, entries by script, macro or other automated means, or entries that do not fully comply with these Official Rules, including without limitation, the Submission Guidelines, or which subvert the entry process, in the sole discretion of Sponsor, will not be eligible. All entries must be received during the Entry Period to be eligible.

Submission Guidelines

Each Entry that is submitted to this Award Program must comply with the following submission guidelines (the "Submission Guidelines") to be eligible. Any Entry that, in Sponsor's sole and absolute discretion, violates these Official Rules or the Submission Guidelines below will be disqualified and/or will not be eligible to win. By participating in this Award Program, entrant grants Sponsor and each BCBS Company permission to use his/her name, likeness, photograph and/or biographical information for advertising, promotional, marketing and publicity purposes in any and all media without additional compensation, notification or permission, unless restricted by law.

The Entry MUST, in the sole discretion of Sponsor:

  • Be written in English;
  • Include a true, original story about the individual entrant (not a friend, family member, or other person), outlining (in 300 words or less) the challenge or obstacle you faced (on or after 01/01/2012 and also occurred at a time when that individual was insured by a BCBS Company) and how your BCBS Company helped you through it (the "Story") and why you believe you should win;
  • Include uplifting or aspirational photos or a video of the entrant that evokes inspiration, and embody moments that affirm a positive, healthy lifestyle (with photos and video that comply with the format and length requirements set forth on the Program Microsite).

The Entry must NOT, in the sole discretion of Sponsor:

  • Contain material that violates or infringes upon another's rights, including but not limited to privacy, publicity or intellectual property rights (including, without limitation, trademark or copyright), without permission;
  • Disparage, misrepresent or reflect negatively on Sponsor or any BCBS Company, or any of their respective products or services, Sponsor's competitors or their products or services, or any other person or party affiliated with the Award Program, or in any way reflect negatively upon such parties or explicitly or implicitly communicate messages or images inconsistent with the positive images and/or goodwill with which Sponsor wishes to be associated;
  • Contain company names, product names, brand names or trademarks (other than to identify the name of the BCBS Company that provides healthcare insurance for the entrant);
  • Contain the names, likenesses, or other indicia identifying any celebrities;
  • Contain the names, likenesses, or other indicia identifying any other individual, public or private figure, living or dead, without permission (using authorization and other forms provided on the Program Microsite);
  • Contain a story about a friend, family member, or any person other than the individual entrant;
  • Contain material that is inappropriate, indecent, obscene, pornographic, profane, hateful, tortious, defamatory, slanderous, controversial or libelous;
  • Contain material that promotes alcohol, illegal drugs or tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous;
  • Contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
  • Contain material that is unlawful, in violation of or contrary to applicable laws or regulations; and/or
  • Contain material with which the Sponsor does not wish to associate itself. 

Grant of Rights

By submitting an Entry, the entrant hereby (a) irrevocably grants to Sponsor and each BCBS Company, and their respective successors and assigns, a non-exclusive, transferable, fully-paid, royalty-free, worldwide, perpetual license, including the unlimited right to sublicense, reproduce, modify, publicly perform, publicly display, distribute, and use the Entry by means of any and all media and devices whether now known or hereafter devised, including, without limitation, on Sponsor's and each BCBS Company's respective websites, Facebook pages, Twitter pages, Instagram pages and other social media pages; and (b) agrees to execute all further documents respecting the entry requested by Sponsor or any BCBS Company, including any further license, in order for Sponsor or any BCBS Company to use the Entry as contemplated by the Award Program. Each entrant irrevocably waives any and all so-called moral rights they may have in the Entry. For clarity, Sponsor and each BCBS Company has the right (but not the obligation) to publish any Entry on any of Sponsor’s and each BCBS Company's respective websites, Twitter pages, Facebook pages, Instagram pages and other social media pages and as Sponsor and each BCBS Company otherwise so chooses.

Representations and Warranties/Indemnification

Each person who enters this Award Program represents and warrants as follows: (i) entrant has obtained any and all necessary permissions required to submit the Entry and for Sponsor’s and each BCBS Company’s right to use the Entry the purposes described above; (ii) the Entry is owned by entrant; (iii) the Entry is true and wholly original with entrant and, as of the date of submission, the Entry is not the subject of any actual or threatened litigation or claim; (iv) the Entry does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity, including, but not limited to, rights of privacy and publicity; and (v) the Entry does not and will not violate any applicable laws, and is not and will not be considered defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Released Parties (as defined below) harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

Winner Determination

After the Entry Period has ended, the judging will take place on or about 03/30/17 – 04/15/17 (the "Judging Period"). During the Judging Period,  judges appointed by Sponsor, in Sponsor's sole discretion (the "Judges"), shall judge all eligible Entries utilizing the following criteria and corresponding points, in order to determine the one (1) potential  Award winner, as further detailed below:

  • Clearly describe the health challenge/obstacle faced (0-15 Points);
  • Demonstrate how your challenge helped you embrace life and live fearless (0-10 Points);
  • Demonstrate how BCBS impacted your efforts to face the challenge and explain how BCBS benefits or services were used to assist and give a sense of security (0-25 Points);
  • Convey fearless attributes (for example, willing to be vulnerable, going against the grain, embracing new challenges, always trying and never giving up, being there for someone else) (0-25 Points); and
  • Have the ability to inspire others to make healthy changes and overcome obstacles in their own lives (0-25 Points).


The Judges will assign each Entry a total score ("Score"). The one (1) Entry with the highest Scores will be the potential Award winner and will be the potential recipient of the Faces of Fearless Award (the "Faces of Fearless Award") to be presented at the 2017 National Summit in Orlando, Florida (the "Summit"). The Award will be awarded provided a sufficient number of eligible Entries are received. In the event of a tie of two (2) or more Entries after the Scores have been assigned, tied Entries will be re-judged by the Judges based solely on criteria (C) and (E) above in order to break the tie. If this first round of tie-breaking judging results in a tie, a neutral tie-breaking Judge, in Sponsor's sole discretion, will be called upon to assign the tied Entries a final Score based upon all five (5) criteria above. The Judges' decisions are final and binding.

POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNER AND OTHER MATTERS RELATED TO THE CONTEST.

Award

The Award consists of the following:

  • Round trip coach class airfare for up to 4 persons (consisting of the winner plus up to 3 friends or family members), from the winner’s residence to and from Orlando, Florida, arriving on 05/09/2017 and departing on 05/12/2017; provided, that if winner resides within a 100-mile radius of Orlando, ground transportation for winner and winner's guests from winner’s residence may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in Award value. Trip must be taken on these dates, only.
  • Hotel for 4 (2 rooms – 3 nights) at the Orlando World Center Marriott® (standard room, double occupancy, to be booked directly by Sponsor).
  • Meals during the stay, not to exceed $200 per person per day, for 3 days (maximum of $600 per person).
  • Ground transportation for winner and winner's 3 guests is limited to group shuttle arrangements in Orlando (to and from the Orlando airport, hotel, and Disney World®) during 5/9/2017-5/12/2017.  All other ground transportation expenses are excluded.
  • 4 General Admission Passes to Disney World® Theme Park – 3 days.
  • Admission to the Summit in Orlando, Florida; subject to restrictions, terms and conditions of the Summit; Sponsor reserves the right to award trip without the Summit.

Sponsor reserves the right, in its sole discretion, to award the Award without the Faces of Fearless Award and/or to cancel, postpone, or change the location of the Summit from any logistics other than during 05/09/2017 through 05/12/2017 at the Orlando World Center Marriott®.

Gratuities, checked baggage fees, telephone calls, all other incidentals, transportation and expenses of any kind not specified above are the sole responsibility of winner and not Sponsor or any BCBS Company. Approximate Retail Value of the Award: $ 5,886 (with transportation costs that will vary, depending on the location of winner’s residence). Difference between actual value and stated value will not be awarded.

Guests accompanying winner must sign liability and publicity release. Minors under the age of 18 not traveling with a parent or legal guardian must be accompanied by an adult over the age of 21 in the same room who the parent or guardian has appointed to have custody and control over their minor.

All flights, hotels, and ground transport for the Award winner and the (up to) three accompanying people will be made by Blue Cross and Blue Shield Association. The Award winner must be able to attend the Summit in Orlando, Florida on the dates of 05/09/17 – 05/12/17; and, without limiting the foregoing, the Award winner must agree to receive the Faces of Fearless Award on stage, on Wednesday, May 10, 2017 during a keynote session for the Summit held at the Orlando World Center Marriott and agrees to be available for up to two hours throughout the week for photos, interviews and discussion. If the Award winner is unable to attend the Summit due to his/her physical health condition (supported by a doctor’s note, to Sponsor’s reasonable satisfaction), then the Award winner must have a representative (such as a family member) available who can to attend in place of the winner; and Sponsor, in Sponsor’s sole discretion, will determine whether to provide the Award to the Award winner or one of the alternate winner(s).  If the winner does not agree to receive the Faces of Fearless Award on stage, on Wednesday, May 10, 2017 during a keynote session for the Summit held at the Orlando World Center Marriott (for any reason other than due to his/her physical health condition, as described above in this paragraph), then the winner will forfeit the Award and Sponsor will provide the Award to one of the alternate winner(s). 

No cash equivalent for the Award and no substitution will be made except as provided herein at the Sponsor’s sole discretion. No portion of the Award may be sold, traded, transferred, refunded, commissioned or redeemed for cash value. Sponsor reserves the right to substitute the listed Award for one of equal or greater value for any reason. Winner is responsible for all taxes and fees associated with Award receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the winner. Winner may be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification). Award will be awarded only if the potential Award winner fully complies with these Official Rules.

Award Winner Notification/Verification

Sponsor will notify the potential Award winner via an email to the address provided upon entry. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry.  In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent.  For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. 

Potential winners will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law), HIPAA Authorization, and all other documents required generally for submission of any Faces of Fearless story on the Program Microsite (collectively, the "Affidavit") which must be executed and returned within three (3) business days from winner's receipt of the Affidavit. The potential winner will be required to execute and return the Affidavit within such time period, or the Award will be forfeited, and an alternate potential Award winner will be selected and notified. In the event the potential winner: (a) cannot be reached for whatever reason after a reasonable effort has been exerted or the potential winner notification or Affidavit is returned as undeliverable; (b) declines or cannot accept, receive or use the Award for any reason; (c) does not comply with the above or within any of the aforesaid time periods, (d) is found to be ineligible to enter the Award Program or receive the Award, (e) cannot or does not comply with the Official Rules, (f) cannot or will not attend the Summit on 05/10/17 (except as provided above in Section 7, at Sponsor's discretion), or (g) fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Award Program and an alternate potential winner may be selected, at Sponsor's sole discretion, from among the other eligible Entries received. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of alternate potential winner, if any.

The Award Winner must be insured by a BCBS Company continuously during the entire Eligibility Period, and must submit a Story about true events that happened to that individual on or after 01/01/2012 and also occurred at a time when that individual was insured by a BCBS Company. If the Award winner is not insured by a BCBS Company during the Eligibility Period or any other time described in this paragraph, for any reason, then he/she will be disqualified and thus forfeit the Award and an alternate potential Award winner will be selected.

Release

Each entrant agrees to defend, indemnify, release and hold harmless the Sponsor, each BCBS Company, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Award Program, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a entrant's Entry, creation of an Entry or submission of an Entry, participation in the Award Program, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of Award (including any travel or activity related thereto), participation, or inability to participate in the Award Program  and/or the broadcast, exploitation or use of Entry. Winner acknowledges that all Awards are awarded AS-IS without warranty of any kind.

General Conditions

Sponsor, each BCBS Company, and the Released Parties shall not have any obligation or responsibility, including any responsibility to award any Award to entrants, with regard to: (a) Entries that contain inaccurate, false or incorrect information or do not comply with or violate the Official Rules; (b) entries, Award claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Award Program or claiming the Award; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the Award for any reason (except as may be permitted, in Sponsor's sole discretion, as set forth above in Section 7); (f) any delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any Award or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any Award or resulting from participating in this Award Program, the Summit or any promotion or Award related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be: (a) tampering with or otherwise abusing the entry process or the operation of the Award Program; (b) acting in violation of the Official Rules or acting in a non-sportsmanlike or disruptive manner; or (c) entering or attempting to enter the Award Program multiple times through the use of multiple registrations or the use of any robotic, mechanical, programmed or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Award Program, or the Award Program is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other causes which Sponsor deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Award Program, Sponsor reserves the right, by posting a notice on the Program Microsite, to void the entries at issue and/or terminate the relevant portion of the Award Program, including the entire Award Program, and/or modify the Award Program and/or award the Award from all eligible Entries received as of the termination date. Except to identify your BCBS Company in the Story and Entry that you submit to this Award Program on the Program Website (as described in Section 3 above), ENTRANT SHALL NOT USE THE “BLUE CROSS” OR “BLUE SHIELD” WORDS, FACES OF FEARLESSSM, SYMBOLS, TRADEMARKS, SERVICE MARKS, OR MAKE ANY REFERENCE TO “BCBSA,” “BLUE CROSS AND BLUE SHIELD ASSOCIATION,” OR ANY BCBS COMPANIES IN ANY MANNER, INCLUDING PRESS RELEASES, PUBLIC STATEMENTS, INTERVIEWS, LETTERS OR EMAIL, OR SOCIAL MEDIA (FACEBOOK, TWITTER, ETC.), WITHOUT THE PRIOR WRITTEN APPROVAL OF BCBSA. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that term.

Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Award Program; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Award Program; (d) technical or human error in the administration of the Award Program or the processing of registrations; (e) damage to entrant's or third person's computer and/or its contents caused by computer virus or otherwise resulting from entrant's access to the Program Microsite, whether human, mechanical or electronic; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Award Program or receipt or use or misuse of any Award. If for any reason an entrant’s registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Award Program. No more than the stated number of the Award will be awarded.

Disputes

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Award Program, or any part of the Award awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Award Program, or any part of the Award awarded, shall be resolved exclusively by the Circuit Court of Cook County, Illinois (First District, Chicago) or the United States District Court for the Northern District of Illinois; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Award Program, but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Award Program, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.

Award Program Results

For Award Program results send a hand-printed, self-addressed, stamped envelope to Winners List – Faces of Fearless Awards Program c/o BCBSA, 225 N. Michigan Avenue, Chicago IL 60601. Requests for the winner list must be received by September 1, 2017.
