Official Rules and Entry Instructions

The BlueCross BlueShield Data Innovation Challenge (the “Challenge”) is presented by the Blue Cross Blue Shield Association (“BCBSA”) and Blue Health Intelligence (“BHI”, BCBSA and BHI are collectively referred to as "Sponsor"), with support from Healthbox Global Partners, LLC, a HIMSS Innovation Company (“Healthbox”).

The Challenge Invites participates to submit an innovative solution ("submission) to one of the use cases identified below, the goal of which is to achieve the triple aim of "Better care for Individuals, Better Health for Populations, and Lower Per Capita Costs."

Eligible Participants
The Challenge is open only to companies and other legal business entities located in the fifty (50) United States (and the District of Columbia), Panama, Uruguay, or Puerto Rico. National and local competitors of BCBSA and/or BCBS Company(ies) are not eligible to enter or win. Employees and directors of Blue Cross and Blue Shield Association, each BCBS Company and its Blue-licensed affiliates and subsidiaries, and any of their agents who were involved in creating or administering the Challenge are not eligible to enter or win.

Use Cases
Entrants' submissions should address one of the following use cases developed by Sponsor for the Challenge (the "Use Case(s)").

  1. Identifying, predicting and prioritizing of members and providers for real-time intervention – To foster better quality and more efficient care, we must be able to identify and predict members who are likely to need care and can be helped by engaging early and in a focused manner. This requires new algorithms and identification techniques involving:
    1. Machine learning
    2. Integration of different data sources (EHR, social data, financial data, genomic data for example)
    3. New approaches to real time data (ADT data, Utilization alerts, etc.) integration into analytics
    4. New approaches to pattern recognition in datasets.
  2. Using data to reduce barriers of care – Barriers to care are real and varied. Often the best most efficient care cannot be achieved only because patients can’t manage the context of their lives or the delivery system is not flexible enough to allow them to include the time and ability to get the right care at the right time. Those barriers include:
    1. Social barriers
    2. Emotional and behavioral barriers
    3. Access barriers, including geographical barriers (rural areas for example)
    4. Cultural and language barriers
    5. Complexity barriers (our system is extremely complex and that limits available of health care)
    6. Other barriers including such items as loneliness, isolation, competing priorities, etc.
  3. Enhancing the members journey through their health care usage – In some ways, the objectives of analytics and patient care are opposites. Analytics are the discovery, interpretation, and communication of meaningful patterns in data and the process of applying those patterns toward effective decision making. Patient care is often the discovery of and intervention into low probability but high consequence events. How does one use analytics to impact the individual’s journey through health care, including:
    1. Optimal decision making by the patient and the care giver
    2. Proper transitions from one caregiver to another and from one site to another
    3. Proper management and decision making of chronicity and secondary prevention (avoiding relapses and recurrences)
    4. Proper lifestyle management to the individual
    5. Other factors that impact the individual patient journey.

Application Process/ How to Enter
To enter the Challenge, you must complete a submission which can be accessed at http://databox.healthbox.com/applicant/login. A submission does not imply any license or transfer of ownership rights. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

Submissions, and all information disclosed orally or in writing in connection with such submissions, must not contain (a) inaccurate or misleading information, (b) confidential information of the entrant’s company or employer or (c) information that violates any third party intellectual property rights or applicable laws such as HIPAA and other privacy laws. Entrant acknowledges and agrees that any information submitted in the submission or in the Entrant's proposals are non-confidential and nothing contained herein shall be construed as limiting Sponsor's (or any BCBS company's or affiliate's) rights to develop, use or market any products or services competitive with the submissions or proposals. Submissions will not be acknowledged or returned, and no correspondence will be entered into by Sponsor to entrant regarding the status of a submission.

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited. The Challenge is governed by these Official Rules and Entry Instructions (the "Rules") and is subject to all applicable federal, state and local laws.

Entry Period
The entry period for the Challenge begins on April 30, 2019 and ends June 25, 2019 at 11:59pm CST (the “Entry Period”). All submissions must be received during the Entry Period to be eligible.

Winner Determination
Eligible submissions will be reviewed by a Challenge selection committee consisting of judges appointed by Sponsor in its discretion (the "Selection Committee"), to determine which have the most potential to leverage a Subset of BHI’s dataset to meaningfully address one or more of the above Use Cases. Scoring criteria will consist of the following factors, which will be weighted equally: Use Case alignment, demonstrated outcomes, scalability, competitive landscape, and data impact (the "Factors").

Submission Guidelines
Any submission that, in Sponsor's and Healthbox's sole and absolute discretion, violates these Rules will be disqualified and/or will not be eligible to win. By participating in this Challenge, entrant and each team member grants Sponsor and each BCBS Company permission to use entrant's and the team member's name, likeness, photograph and/or biographical information for advertising, promotional, marketing and publicity purposes in any and all media without additional compensation, notification or permission, unless restricted by law.

Finalist Selection
The entrants with the top five (5) scores on their submissions will be the finalists (the "Finalists") and Sponsor will notify the Finalists of their status on or about July 31, 2019, via an email to the address provided in the submission. After a collaborative discussion with Sponsor, Finalists will be provided access from BHI to a relevant and limited subset of BHI-owned data (the "Subset") and other BHI resources to test their hypothesis; the BHI resources and the content of the Subset will be determined by Sponsor in its discretion. The Finalists will be required to agree to additional terms and conditions in order to use and access the Subset, including but not limited to a Data Use Agreement, security evaluation, and/or a Business Associate Agreement.

Selected Finalists must:

  • Explicitly outline the proposal to leverage the Subset;
  • Clearly articulate data requirements to execute on outlined proposal;
  • Demonstrate value by leveraging access to the Subset within a 2-4 month period; and
  • Summarize results in the form of a brief presentation deck.

Finalists will have 2-4 months to test their proposed use case using the Subset. Upon completion, each Finalist will present a brief presentation to the Selection Committee, as well as a wider BCBS audience, to demonstrate the solutions’ effectiveness at a time and place selected by Sponsor (the "Presentation").

Challenge Prize
One (1) potential final winner (the "Winner") will be selected by the Selection Committee determined by scoring of the Presentation based on the Factors. Sponsor will notify the Winner of its status on or about October 31, 2019, via an email to the address provided in the submission. The Winner will receive (a) access to a relevant and limited data Subset selected by Sponsor in its sole discretion from BHI for a six-month period; and (b) BCBSA and BHI will have the ability to work directly with the Winner to provide assistance in publicizing work and/or market to BCBS Plans through various forums in Sponsor’s discretion (collectively, the "Prize"). Winner will be required to agree to additional terms and conditions in order to use and access the Subset, including but not limited to a Data Use Agreement, security evaluation, and/or a Business Associate Agreement. Any public statements by the Winner or referring to the Winner shall be subject to mutual review and prior written approval of Sponsor and the Winner.

The estimated retail value of the Prize will vary depending on the agreed upon data Subset. Sponsor shall provide an estimated retail value once and if the applicable data Subset is agreed upon. Difference between actual value and stated value will not be awarded.

The potential Winner will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law), and all other documents required by Sponsor (collectively, the “Affidavit”) which must be executed and returned within three (3) business days from each potential Winner’s receipt of the Affidavit or the Prize will be forfeited, and an alternate potential Winner may be selected and notified, as described above. If a potential Winner: (a) cannot be reached for any reason after a reasonable effort has been exerted; (b) declines or cannot accept or is ineligible to receive the Prize; and/or (c) cannot or does not comply with these Rules then that potential Winner shall be disqualified from the Challenge and an alternate potential Winner may be selected, at Sponsor’s sole discretion. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of the potential winner. BCBSA, BHI, and Healthbox are not making or committing to make an investment in or financial commitment to your Company by virtue of participation in this Challenge. Nothing contained in these Rules shall be construed as creating any obligation for or an expectation on the part of either party to enter into a business relationship or consummate any transaction with the other party, unless and until a definitive agreement between them has been executed.

No cash equivalent for the Prize and no substitution will be made except as provided herein at the Sponsor’s sole discretion. No portion of the Prize may be sold, traded, transferred, refunded, commissioned or redeemed for cash value. Sponsor reserves the right to substitute the listed Prize for one of equal or greater value for any reason. Each Winner is responsible for all taxes and fees associated with Prize receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the Winner(s).

Entrant’s Personal Information
Entrants expressly consent to receiving electronic messages relating to participation in the Challenge. BCBSA, BHI, Healthbox and their respective agents, affiliates, subsidiaries, representatives, or service providers may use entrants’ personal information submitted with submission for purposes of communicating with entrants, and/or prize fulfillment. By entering, entrants consent to such use of their personal information. Information collected from entrants is subject to the Sponsor’s Privacy Policy, which is available at bcbs.com/privacy-policy.

Representations and Warranties/Indemnification
By submitting a submission, each entrant represents, warrants and covenants as follows:

  • Entrants are the sole author, creator, and owner of the submission and/or Entrant has obtained any and all necessary permissions required to make the submission;
  • The submission is not the subject of any actual or threatened litigation or claim;
  • The submission does not and will not violate or infringe upon the intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
  • The submission, and entrants’ use of the submission, does not and will not violate any applicable laws or regulations of the U.S. and other jurisdictions;

Entrants must indemnify, defend, and hold harmless BCBSA, BHI, and Healthbox, and their respective parent companies, subsidiaries, representatives and affiliates, and the partners, directors, officers, employees, agents and attorneys, (collectively, the "BCBSA Parties") from and against all claims, expenses, and liability of any kind arising out of or relating to: (i) any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder, (ii) entrant’s submission, or (iii) entrant's use of the Prize.

Use of the Blue Brands
Entrants shall not use the BLUE CROSS or BLUE SHIELD word or design trademarks, service marks, or any other trademark owned by BCBSA (collectively, “Blue Brands”), and shall not make any reference to BCBSA or the Member Plans in any way (e.g., in Entrant’s advertising, letterhead, symbol or logo, business or product name, press releases, customer lists). BCBSA may, at its sole discretion, permit Entrant by exception to use the Blue Brands or make reference to BCBSA. In the event that BCBSA, in its sole discretion, permits such an exception, use by Entrant must be specified in writing by BCBSA and Entrant acknowledges that all use of the Blue Brands must inure to the benefit of BCBSA and must comply with all applicable BCBSA rules and regulations.

Limitations of Liability
The BCBSA Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Challenge; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Challenge; (d) technical or human error in the administration of the Challenge or the processing of submissions; (e) damage to entrant’s or third person’s computer and/or its contents caused by computer virus or otherwise resulting from entrant's access to the website for the Challenge, whether human, mechanical or electronic; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Challenge or receipt or use or misuse of any Prize. If for any reason an entrant’s submission is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Challenge.

EACH ENTRANT ACKNOWLEDGES THAT NEITHER BCBSA, BHI, OR HEALTHBOX MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE DATA MADE AVAILABLE FOR THE CHALLENGE, AND THAT SUCH DATA IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTY, AND THAT SUCH DATA MAY BE SUPPLEMENTED OR REMOVED FROM THE DATA SET BY SPONSOR AT ANY TIME AND FOR ANY REASON. ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. IN NO EVENT SHALL BCBSA’S, BHI’S AND/OR HEALTHBOX’S AGGREGATE LIABILITY HEREUNDER, BASED ON ANY THEORY OF LIABILITY OR CAUSE OF ACTION, EXCEED THE REASONABLE AND ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CHALLENGE, BUT IN NO EVENT ATTORNEYS’ FEES. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, IN NO EVENT SHALL BCBSA, BHI AND/OR HEALTHBOX BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, SAVINGS OR REVENUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Illinois, without regard to any conflicts of law principles applied in that state. Any suit or proceeding relating to the Challenge shall be brought only in Cook County, Illinois.

General Conditions
BCBSA, BHI, and Healthbox are not responsible for late, lost, illegible, misdirected, incomplete, incorrect, entries or prize claims. BCBSA, BHI, and Healthbox are also not responsible for incomplete, interrupted, or scrambled transmissions, unavailable web sites, networks, servers, or systems, or other connection or transmission problems, technical malfunctions of the computer, software, web site, or any combination thereof, problems associated with any virus or other damage caused to any entrant’s system or other problems of any kind, whether mechanical, electronic, or human. In addition, BCBSA, BHI, and Healthbox are not responsible for exposure of material due to cyber breach.

All decisions of the Selection Committee are final and binding. POTENTIAL WINNER(S) ARE SUBJECT TO VERIFICATION BY SPONSOR AND SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION AND OPERATION OF THE CONTEST, SELECTION OF THE WINNER(S) AND OTHER MATTERS RELATED TO THE CONTEST.

If, for any reason, the Challenge is not capable of running as planned due to, without limitation, errors in these Rules or advertising for the Challenge, tampering, unauthorized intervention, fraud, technical failures, human error or any other cause that, in the sole judgment of BCBSA, BHI, and Healthbox, could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Challenge or Subset, BCBSA, BHI, and Healthbox reserve the right, at its/their sole discretion, to cancel, terminate, modify and/or suspend the Challenge or any part of it, and/or award the Prize from all eligible submissions received as of the termination date by posting a notice at https://www-stage.bcbs.com/bluecross-blueshield-data-innovation-challenge.

Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that term.
